SPOTLIGHT

The Ministry of Economy and Finance confirmed the proposal to use a trust to guarantee the continuity of the investment projects executed by construction companies under corruption investigation 

Considering that next February 14th the term of Emergency Decree N ° 003-2017 expires, which approved several measures to avoid transfers of companies linked to corruption cases, as well as to guarantee the payment of the corresponding compensation in favor of the Peruvian state, the Ministry of Economy, together with the Ministry of Justice and Human Rights, submitted a law project to the Congress of the Republic, with the purpose of replacing the regulations that will expired.

Within the submitted proposal, the use of the trust scheme is considered to ensure the retention of up to 50% of profits to guarantee the payment of civil compensation. Likewise, the objective of the bill is to provide predictability, in the short term, to the companies investigated regarding the amount of civil compensation, with the purpose of not affecting the financing of the projects or the payments structure of such projects. Finally, among other proposed measures, are the implementation of compliance programs, as well as mechanisms to ensure the payment of future tax obligations.

MONDAY 12

  • The Ministry of Energy and Mines approved the environmental impact study presented by Luz del Sur for the development of the Santa Teresa 2 hydroelectric project, located in Cusco, which will require an investment of US$ 600 million. This project will increase the capacity of the San Teresa hydroelectric plant (Gestión).

  • The Organizing Committee of the Panamerican Games Lima 2019 reported that the last three infrastructure projects will be awarded in April (Gestión).

  • The Minister of Transport and Communications, Bruno Giuffra, announced that within 10 days a new schedule will be issued for the execution of the first stage of the "Chinchero International Airport" project through the public works scheme (Gestión).


FRIDAY 09

  • ProInversión presented the project "Tren Huancayo - Huancavelica" to various investors and investment banking agents. The project, with an estimated investment of US$ 225 million, will be awarded during the third quarter of 2018 (Gestión).

  • Strike Resources reported that it is evaluating the construction of a 570 km railway in Andahuaylas to transport minerals from its mining prospects (Gestión).


THURSDAY 08

  • Kuntur Wasi confirmed the return of land from the "Chinchero International Airport" project and the delivery of the detailed technical studies. However, it confirms that it will initiate an arbitration proceeding against the Peruvian state before the ICSID (Gestión).

  • The Ministry of Economy and Finance confirmed the proposal to use a trust to guarantee the continuity of the investment projects executed by construction companies under corruption investigation (Gestión).

  • The Peruvian government announced that it is evaluating the issuance of another emergency decree in replacement of Emergency Decree No. 003-2017 (Gestión).


WEDNESDAY 07

  • Southern Peru reported that the proposed operation of the "Los Chacas" mining complex will begin in 2025, with an estimated investment of US$ 2,900 million (Gestión).


TUESDAY 06

  • Benefit plant of the company Shoungan Hierro, with an investment of US$ 500 million, will start operations in the second half of 2018 (Gestión).
