SPOTLIGHT

The Peruvian government completed the draft regulation of Law No. 30737 that replaces Emergency Decree No. 003-2017. Such regulation should be approved in the first half of this month

The Peruvian government concluded last Friday the draft of the regulation of Law No. 30737 (law that replaces Emergency Decree No. 003-2017). However, this new regulation does not yet have the approval of the entities of the financial system, who still maintain their skepticism regarding financing to construction companies.

Among the main novelties of the regulation are the procedure for the exact determination of the civil reparation in favor of the Peruvian State, based on which the trust for the collection of such amounts will be stablished and the processes of purchase of assets and rights of companies involved in corruption acts will be carried on. Likewise, the determination of fixed terms for the procedures within the framework of said regulation will allow a predictability of the companies to consider the committed flows and thus obtain a better financing.
