SPOTLIGHT

The Peruvian Government promulgated Legislative Decree No. 1362 "Legislative Decree Regulating the Promotion of Private Investment through Public-Private Partnerships and Projects in Assets"

Today the Peruvian government published the Legislative Decree No. 1362 "Legislative Decree Regulating the Promotion of Private Investment through Public-Private Partnerships and Projects in Assets", a law that replaces the current legal framework of public-private.

Within the modifications incorporated, the new regulation seeks to return the direction of the promotion of PPPs to the Ministry of Economy and Finance as the entity in charge of dictating the policies of private investment. Likewise, the law seeks to have clear and transparent procedures for the development of infrastructure projects in the country under this scheme, as well as having better technical studies from the conception of projects, in order to avoid changes during its bidding.

On the other hand, structural changes are incorporated into ProInversión, including a modification to the composition of its board of directors, whereby the five members will be representatives of the government. Likewise, the functions of the entity, the project director, the special committees, the executive director and the board of directors are being redefined. Finally, the law seeks to repower the project management team of ProInversión.

One of the most important changes incorporated is the possibility granted to the government to contract technical and legal specialists from the private sector to advise on the negotiation of concession agreements, in order for such agreements to protect the position of the government against private investors.

Likewise, the ministries will be allowed to create a specialized group that will concentrate project management functions so then could be outsourced by the ministry.

MONDAY 23

  • The restart of the works of the "Majes-Siguas II" project will take place in September of this year, due to the fact that the project must be adapted to the new costs recognized in the last subscribed addendum (Gestión).

  • The Ministry of Transport and Communications declared the viability of the broadband connectivity project in Iquitos. Project will demand an investment of US$ 95 million (Gestión).

  • The Vice Minister of Communications, Rosa Nakagawa, stated that during the second half of 2018, 3 broadband connectivity projects will be declared viable, for a total value of US$ 209 million (Gestión).

  • The Peruvian Government promulgated Legislative Decree No. 1362 "Legislative Decree Regulating the Promotion of Private Investment through Public-Private Partnerships and Projects in Assets" (Gestión).


FRIDAY 20

  • ProInversión announced the call for tender process for the repowering project of the Carabayllo-Chimbote-Trujillo 500kV transmission line, and works in the Trujillo Substation, which will be awarded in December 2018 and will require an investment of US$ 90 million (Gestión).


THURSDAY 19

  • Continua Energías Positivas reported that it plans to invest US$ 299 million in a solar energy project in Arequipa (Gestión).

  • The Peruvian government reported that it will evaluate the proposal for the expansion of the North and South docks of the Port of Callao with respect to the possibility of allowing the entry of railroad cargo from the central railway (Gestión).

  • The Ministry of Energy and Mines reported that it is preparing a regulatory framework to promote greater investment in renewable energies (Gestión).


WEDNESDAY 18

  • The Minister of Transport and Communications, Edmer Trujillo, declared that the ministry expects to close the addendum to the concession agreement of the Line 2 of the Lima and Callao Metro project in the coming days (Gestión).

  • The Ministry of Transport and Communications foresees that the project for the construction and modernization of the port of San Juan de Marcona (Ica) will be declared of interest towards the end of this year, while the port terminal of Chimbote would be declared of interest in March 2019 (Gestión).

  • Luz del Sur and the Regional Government of Arequipa signed the agreement for the development of the hydroelectric power plants "Llutay" and "Lluclla", which make the hydroelectric component of the Majes-Siguas II special project (Gestión).


TUESDAY 17

  • Macusani Yelowcake reported that it expects to build and operate a mine in the lithium deposit recently found in Puno, which would require an estimated investment of US$ 800 million (Gestión).

  • ProInversión announced the call for the tender process for the concession of the project "Wastewater Treatment System of the Titicaca Lake Basin", which is expected to be awarded on December. To date there are three qualified bidders for the contest (Gestión).
